The issue is freedom. Government is force. Force against non-force, e.g. faith/non-faith, economics, science, education, media, art, is EVIL.

If DeMint wants to advocate religious values, he is free to do so in the PRIVATE, i.e. COERCION-FREE, sector. That he wants to do so in the realm of FORCE makes him a tyrant-wannabe.

The problem of indoctrination comes in when we allow the government to have a monopoly on the education of our children. It only follows that those in government will be tempted to teach our children what they choose rather than what we choose.

As to the Jefferson "Wall" between Church and State, this is one of the most misused statements by a Founding Father. The context of his statement is important. The 1st Amendment says "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof".

That is "Congress" as in the Federal Legislature of the land. This did NOT mean the states, which to this day still have the authority over government education (the Federal Government now is able to extort the States into following Federal diktats through the power of Federal monies via the Federal Income Tax). As further evidence that this did not apply to the States, in the Supreme Court Case, Barron vs. Baltimore in 1833, the high court confirmed that the Bill of Rights did not apply to the States, only to the Federal Government.

So in effect Jefferson's statement was more about the concept of a limited Federal Government (e.g., the 9th and 10th Amendments) rather than a strict separation of Church and State at all levels of government. He felt the issue was one left to the state and local governments, which were more likely to be responsive to the people.

Further evidence that Jefferson was only referring to the Congress in his letter to the Danbury Baptists of Connecticut is his statement he made at his second inaugural address:

"In matters of religion, I have considered that its free exercise is placed by the constitution independent of the power of the federal government. I have therefore undertaken, on no occasion, to prescribe the religious exercises suited to it; but have left them, as the constitution found them, under the direction of state or church authorities acknowledged by the several religious societies"
(Jefferson's Second Inaugural Address)

Here is also another quote of Jefferson's confirming his views:

"I consider the government of the United States as interdicted by the Constitution from intermeddling in religious institutions, their doctrines, discipline, or exercises. This results not only from the provision that no law shall be made respecting the establishment or free exercise of religion, but from that also which reserves to the states the powers not delegated to the United States. Certainly, no power to prescribe any religious exercise or to assume authority in religious discipline has been delegated to the General Government. It must rest with the States, as far as it can be in any human authority"
(letter to Samuel Miller, Jan. 23, 1808).

It wasn't until the reconstruction amendments, specifically the 14th Amendment, was most of the Bill of Rights extended to the States, which was more about making sure former slaves were given full rights as citizens of the United States, than it was about extending the separation of church and state to the state and local governments.

1) "Governments are instituted" -> The ONLY proper function of all freedom-based governments, general or particular, federal or state, is "to secure these rights", among which is religious freedom.

Freedom is the absence of force in all non-force realms, e.g. religious beliefs, e.g. intelligent design.

2) "deriving their just powers from the consent of the governed" -> citizens cannot delegate a right they do not possess. No one has a right to RAM DOWN his/her religious beliefs. Did you not read anything I posted? Clearly you are beating a dead horse by continuing to repeat the same misinterpreted statement. Repeating the statement, doesn't change the meaning and the context within which it was said.

Jefferson clearly stated that religion was best left to the States and the Church. The "Wall of Separation" was between the Federal Government and Religion/State Authority on Religion. There where even a number of States, which had official religions. For example Massachusetts funded the Congregational Church up until 1833.

The "Congress" is the Congress of the United States. It doesn't say the States or the State Legislatures. There is only one Congress of the land within the context of the Constitution.

You are subscribing to a Progressive/Socialist misinterpretation and twisting of Jefferson's words.

As to the Bill of Rights, the States ratified them but as I said, and the Supreme Court confirmed this in 1833, that the Bill of Rights did not apply to the states, so continuing to argue otherwise is rather disingenuous.

You mistake my argument. I am not arguing that we should allow "religious" teaching in public schools. As I stated the 14th Amendment requires the States to adhere to the Bill of Rights and I would presume the 1st Amendment.

My issue is with your using a Progressive/Socialist misinterpretation of the words of Thomas Jefferson and one of the key fundamentals of the original Constitution, i.e., the rights the states retain because of the limitations on the Federal Government, as the basis for your argument.

Progressives manipulate history to justify their current agenda. Conservatives depend on facts and logic.

The University of Virginia is the first school of higher education without religious instruction. "Jefferson even went so far as to ban the teaching of Theology altogether. Again, dancing around my argument. I provided specific quotes from Thomas Jefferson, which specifically said that religion was best left to the States and Religions institutions. You keep trying to rationalize your claim of this fictional "wall" by posting irrelevant facts.

What one thinks should be done, is different than allowing others the freedom to determine what is done. Jefferson's opinion on religion is irrelevant as to the Federal Government. Since he believed the Federal Government did not have the right to be pro religion nor anti religion, it was up to the states to make that determination.

If people didn't like living in one state, they could move to another state.
